Terms and Conditions

Product Orders

All orders for products placed with Lamppost Brackets Ltd (the “Company”) by the customer (including councils, retail parks, distributors, etc.) are subject to these Terms and Conditions unless otherwise specified in a written agreement.

1. Minimum Order Quantity

The minimum order is 200 sets unless a prior agreement is in place. Orders below this quantity will not be accepted, except for the exception noted below.

2. Payment Terms

All payments are required at the time of delivery.
No credit terms are available under any circumstances.

3. Delivery Timeline

Delivery is estimated at 4-6 weeks from the date of order placement, though times may vary.

4. Finality of Orders

All orders are final upon confirmation. No cancellations, returns, or exchanges are allowed.

5. Special Agreements

Orders for Ashby are exempt from the minimum quantity requirement due to a 2012 agreement. However, standard payment terms still apply.

6. Resale Price Policy

Distributors must not alter resale prices without prior written approval. The minimum resale price is £99 per set (excluding fixings), and any price adjustments must be approved in writing.

7. Warranty

The Company provides a three-year warranty on brackets under “Return to Base and Repair/Replacement” terms.
The warranty applies only to the original purchaser and covers brackets and fiberglass poles.
The warranty excludes damage caused by misuse, weather conditions exceeding F-0 on the Fujita Scale, shipping, labor costs, or improper maintenance.
Claims must include photos of installations, maintenance records, and relevant National Weather Service reports.

8. Maintenance

Customers must maintain products, including checking and replacing bands as needed. The removal of banners is recommended when severe weather (F-0 or higher) is forecasted.

9. Restrictions on Resale

Distributors are prohibited from selling products to buyers using or mixing systems from other manufacturers. This policy is strictly enforced.

10. Compliance and Amendments

All distributors must comply with these terms. Non-compliance may lead to contract termination and legal action.
Terms may be amended periodically, with updates provided in writing.

11. Governing Law

These terms are governed by the laws of England, with disputes subject to the exclusive jurisdiction of English courts.


Display Space Orders

1. Ownership of Advertising Space
The Company rents advertising space on behalf of site owners (e.g., local authorities). Ownership of the space, hardware, or printed materials remains with the site owner.

2. Advertising Agencies
Agencies contracting with the Company will act as customers and are responsible for payments and approvals. Agencies cannot subcontract without prior agreement.

3. Approval of Artwork
All artwork is subject to approval by the site owner and the Company. The Company reserves the right to reject artwork at any stage.

4. Artwork Creation
Customers must supply high-quality logos and text promptly. Artwork produced by the Company remains its property.

5. Campaign Commencement
Campaigns begin upon installation of advertisements or when delayed approvals or payments are resolved.

6. Site Access
Customers may not access advertising sites without written permission from the Company and the site owner.

7. Payments
Initial payments are required when signing the contract.
Invoices are due within 30 days unless otherwise specified. Late payments incur a 2% monthly interest rate.

8. Cancellation
Written cancellation notice is required. Cancellation fees will apply as detailed in the contract.
Production-related cancellations before production incur a £300+VAT fee.

9. Liability and Indemnity
The Company is not liable for consequential losses. Customers indemnify the Company against claims related to the misuse or failure of products or services.

10. Amendments
Terms may be revised, with changes communicated via email or post.

11. Entire Agreement
This document represents the full agreement between the parties, superseding prior communications.
